1. What are terms and conditions

Terms and conditions are rules you have to agree to before you can use certain products or services, like social media. Terms and conditions are part of English law, and if you want to access a product or service then you will need to confirm that you accept them.

2. How to accept these terms and conditions

By using the Platform, you are saying you accept the Navigatr terms of use and that you will follow (comply) with them. If you do not agree, then you must not use the Platform.

You are responsible for keeping up to date with changes made to these terms and conditions, so check them regularly to make sure you understand the terms that apply all the time.

Credly will contact you separately to notify you when their terms and conditions have changed.

Region of Learning

The Platform has been co-developed in partnership with Cambridge City Council and the Cambridgeshire and Peterborough Region of Learning, Skills and Opportunity (CPRoLSO). The Region of Learning Community has been co-developed in partnership with Navigatr Limited, and is managed by Navigatr Limited as part of a service agreement with Cambridge City Council. Only applicable if you joined Navigatr before 1 February 2023:

3. Changes we may make to our terms and conditions

We may amend these terms from time to time, this includes:

  • Updating them to reflect changes in the Platform, or how people use it.

  • Stopping or restricting the availability of the Platform

  • Transferring them on to another organisation

If any of the above happens, we will tell you in writing and we will make sure it does not affect your rights.

4. What you must do

You must keep your account details safe

If you are provided with a user identification code, password or any other information as part of our security processes you must keep it confidential (do not share with anyone else).

If it is detected that you have not followed these terms of use then we may disable your user identification or password.

If you think someone other than you knows your user identification code or password you must tell us straight away at hello@navigtr.org.

Region of Learning

If you are a member of the Region of Learning Community: Peterborough and Cambridgeshire, led by Cambridge City Council, and you know or suspect that anyone other than you know your user identification code or password, you must promptly notify us by emailing infogov@3csharedservices.org.

Anything you put on our site must be yours

Any content must be yours and must not break any laws. Anything you put on the site must not be private or belong to someone else or be branded. You are only allowed to use the Platform for your own use.

Do not introduce viruses or other harmful technology

You must not attack or try to gain access to the site, service or databases used by our site. If you do, it would be a criminal offence under the Computer Misuse Act 1990 and you will be reported to law enforcement and your identity will be given to them. You will also not be allowed to use this site.

Use adequate virus protection

You must make sure your computer or internet access point works and is fit for purpose, including adequate virus protection software. You must not create a link to our site in any website that is not owned by you. Or to any other page than the home page.

5. What we must do

Navigatr must:

  • Remove anything from the site if we feel it does not follow these terms and conditions.

  • Block access to people who have shared their password or security information

  • Share your identity if someone claims you have posted or put anything on the site that does not belong to you or you have broken someone’s right to privacy.

  • Only use your personal information as we have said in our Privacy Policy

6. We are not responsible for

Navigatr does not have responsibility for any of the following:

  • The content of websites linked to our site.

  • Viruses from our site.

These terms and conditions are governed by English Law. You and we both agree that the courts of England and Wales will be in charge and referred to if there is a problem. If you are in Northern Ireland you can also call on Northern Irish law and in Scotland call on Scottish law.

Detailed Version

1. Introduction

The Navigatr app (“the Platform”) is a site operated by Navigatr Limited ("We"). We are registered in England and Wales under company number 11761403 and have our registered office at Castleton Mill, Castleton Close, Leeds, West Yorkshire, LS12 2DS.

Region of Learning

The Navigatr digital platform has been co-developed in partnership with Cambridge City Council and the Cambridgeshire and Peterborough Region of Learning, Skills and Opportunity (CPRoLSO). The Region of Learning Community has been co-developed in partnership with Navigatr Limited, is managed by Navigatr Limited as part of a service agreement with Cambridge City Council.

The Cambridgeshire and Peterborough Region of Learning, Skills and Opportunity (CPRoLSO) is managed and operated by Cambridge City Council of Mandela House, 4 Regent Street, Cambridge, Cambridgeshire CB2 1BY.

2. By using our site, you accept these terms

By using our site, you confirm that you accept these terms of use and that you agree to comply with them.

If you do not agree to these terms, you must not use our site.

3. We may make changes to these terms

We may amend these terms from time to time. Every time you wish to use our site, please check these terms to ensure you understand the terms that apply at that time.

4. We may make changes to our site

We may update and change our site from time to time to reflect changes to the Navigatr app, and our users' needs.

5. We may suspend or withdraw our site

Our site is made available free of charge to individuals.

We do not guarantee that our site, or any content on it, will always be available or be uninterrupted. We may suspend, withdraw or restrict the availability of all or any part of our site for business and operational reasons.

6. We may transfer this agreement to someone else

We may transfer our rights and obligations under these terms to another organisation. We will always tell you in writing if this happens and we will ensure that the transfer will not affect your rights.

7. You must keep your account details safe

If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential. You must not disclose it to any third party.

We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these terms of use.

If you know or suspect that anyone other than you knows your user identification code or password, you must promptly notify us at hello@navigtr.app.

If you are a member of the Region of Learning Community: Peterborough and Cambridgeshire, led by Cambridge City Council, and you know or suspect that anyone other than you know your user identification code or password, you must promptly notify us by emailing infogov@3csharedservices.org or you can write to us and mark your letter for the attention of the Data Protection Officer. 8. How you may use material on our site

We are the owner or the licensee of all intellectual property rights in our site, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.

You may use the content and functionality on our site for your personal use.

You must not use any part of the content on our site for business or commercial purposes without obtaining a licence to do so from us.

9. Do not rely on the information on this site

The content on our site is provided for general information only. It is not intended to amount to advice on which you should rely. You must obtain professional or specialist advice before taking, or refraining from, any action on the basis of the content on our site.

Although we make reasonable efforts to update the information on our site, we make no representations, warranties or guarantees, whether express or implied, that the content on our site is accurate, complete or up to date.

Where our site contains links to other sites and resources provided by third parties, these links are provided for your information only. Such links should not be interpreted as approval by us of those linked websites or information you may obtain from them.

We have no control over the contents of those sites or resources.

11. User-generated content is not approved by us

This website may include information and materials uploaded by other users of the site. This information and these materials have not been verified or approved by us. The views expressed by other users on our site do not represent our views or values.

12. Our responsibility for loss or damage suffered by you

Whether you are an individual, a provider, community provider, or employer:

  • We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors and for fraud or fraudulent misrepresentation.

  • In respect of liability which cannot be excluded by law, our liability to you in respect of your use of our site is capped at the fees (if any) paid to us in the 12 months preceding the date on which the claim giving rise to such liability arose.

If you are a business user, which includes Providers, Communities, and Employers:

  • We exclude all implied conditions, warranties, representations or other terms that may apply to our site or any content on it.

  • We will not be liable to you for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:

  • use of, or inability to use, our site; or

  • use of or reliance on any content displayed on our site.

  • In particular, we will not be liable for:

    • loss of profits, sales, business, or revenue;

    • business interruption;

    • loss of anticipated savings;

    • loss of business opportunity, goodwill or reputation; or

    • any indirect or consequential loss or damage.

  • Please note that we only provide our site for personal and private use. You agree not to use our site for any commercial or business purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

Any content you upload or input to our site will be considered non-confidential and non-proprietary. You retain all of your ownership rights in your content, but you grant other users of our site a limited licence to use, store and copy that content (such as digital badges, pathways or activities) and to distribute and make it available to third parties.

We also have the right to disclose your identity to any third party who is claiming that any content posted or uploaded by you to our site constitutes a violation of their intellectual property rights, or of their right to privacy.

We have the right to remove any posting you make on our site if, in our opinion, your post does not comply with these terms.

We are not responsible for viruses and you must not introduce them.

We do not guarantee that our site will be secure or free from bugs or viruses.

You are responsible for configuring your information technology, computer programmes and platform to access our site. You should use your own virus protection software.

You must not misuse our site by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful. You must not attempt to gain unauthorised access to our site, the server on which our site is stored or any server, computer or database connected to our site. You must not attack our site via a denial-of-service attack or a distributed denial-of-service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will cooperate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our site will cease immediately.

16. Rules about linking to our site

You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it.

You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.

We reserve the right to withdraw linking permission without notice.

We work with different technical partners to deliver our core services and these are:

  • Real Ideas Organisation (operated as Badge Nation) of Devonport Guildhall, Kerr Street, Plymouth PL1 4EL; and

  • Credly, Inc. (a Delaware corporation) of New York City. Our registered address is 368 9th Avenue, 6th Floor, New York, NY 10001. Credly is a wholly owned subsidiary of NCS Pearson, Inc.

We would share and receive information from Credly (your name and email address) so we can show your digital badges on your Platform profile.

18. Credly: Earner Terms of Service

We deliver the Digital Badge functions of Our Service through Credly, an authorised third-party technical partner and Data Processor based in the United States. By using the Credly services, you agree to be bound by the Earner Terms of Service (https://info.credly.com/earner-terms-of-service).

To use the Credly Services, you must be at least 13 years old and not be restricted by Credly from using the Services. If you register an account on Credly (https://credly.com/users/sign_up), you agree to the Earner Terms of Service (https://info.credly.com/earner-terms-of-service) and the Data Privacy Policy (https://info.credly.com/privacy-policy).

Credly may modify the Earner TOS or its Privacy Policy at any time, and you may want to read the most current version of their full Earner TOS information here.
